Digest of COSHAB's Decision After Reconsideration dated December 11, 1998, Docket No. 97-R3D1-2359. James P. Gazdecki, Chairman; Bill Duplissea and Bryan E. Carver, Members.

The Appeals Board affirmed the ALJ decision of August 28, 1998 [Digest 19,366], finding a serious violation and assessing a $560 penalty.

Employer was excavating and installing 36-inch storm drains for roadway construction when it was inspected. Because employees were working in unshored trenches more than five feet deep, the Division cited under 1541.1(a)(1), and the ALJ affirmed the serious violation, along with the proposed $560 penalty.
