Employer, a Metro Rail project contractor, was inspected at two of its underground rail station work sites. The same four alleged general violations related to ventilation were found at both sites. The Division cited the four for each rail station site, proposing a $750 penalty for each of the eight items. Employer appealed and the Appeals Board consolidated the two identical sets of citations and appeals for hearing.
