The Appeals Board denied Employer's petition to reconsider the ALJ decision of February 19, 1999 [Digest 19,517], which had established a serious violation with a $1,405 penalty.
The Division's inspection was the result of a walk-by observation by a safety engineer. He cited for a trench shield violation (1541.1(g)(2)). Employer appealed and the ALJ denied the appeal, finding the violation and affirming the proposed penalty. Employer then petitioned for reconsideration.
