The Appeals Board affirmed the ALJ decision of March 6, 1995 [Digest 18,754], establishing a serious violation of 1632(i) and assessing a $5,625 penalty.

Employer, a Metro Rail contractor, was cited following an accident in which an employee fell 16 feet through a 4' by 4' hole in temporary flooring. There was no guardrail surrounding the hole or cover secured from displacement, as required by 1632(i). Employer appealed, the ALJ found against it, and a petition for reconsideration was filed.
