Employer, a business selling sporting goods, received a May 1998 programmed inspection. The Division cited for one regulatory and one general violation, proposing penalties of $175 and $85. During the hearing the Division amended the general violation to a Notice in Lieu of Violation with no penalty because the violation had no "immediate impact" on employee safety or health.
