The Appeals Board affirmed the ALJ decision of December 14, 1995 [Digest 18,875], granting Employer's appeal from a Notice of Failure to Abate a serious violation and the associated $19,500 penalty.

A fatal-accident inspection resulted in a citation for a serious violation of guardrail requirements (3210(a)) and a $5,000 penalty.
