27 COR 40-4013 [19,749]
PENALTY - REASONABLENESS
A $5,000 proposed penalty for a serious accident-related violation was properly calculated and appropriate where Employer presented no evidence to the contrary.
SERIOUS VIOLATION - CLASSIFICATION
Serious classification appropriate for plain-view guarding violation capable of causing serious harm or death. Employer's assumption that guarding was adequate was no excuse; guarding must be sufficient to prevent a person from reaching behind it.
