PENALTIES - DUPLICATIVE
The Appeals Board held that the ALJ inappropriately set aside the penalty for one of two electrical cord violations because, he determined, they required the same abatement. Although the hazard of electrical shock was the same from spliced electrical cords that were also missing grounding plugs, the ALJ's conclusion that replacing the entire cords would abate both violations was incorrect. New electrical cords may be obtained that only have two prongs but lack a grounding pole. Therefore, abatement of one violation would not necessarily abate the other, and separate penalties were appropriate.
