LEAD - MONITORING, PROTECTIONS, COMPLIANCE PROGRAM, CONTAMINATION AND REGULATED AREA

CAL. CODE REGS, tit. 8, 1532.1(d)(1), (d)(2)E), (e)(2)(A), (h)(1) and (i)(6)(A) (2000) - Employer did not contest the existence of five general violations related to lead exposures at its job site, and they were affirmed by operation of law. Its argument that the site was declared lead free by the property owner was rejected as a reason to overturn the penalties. An employer has a non-delegable duty to provide a safe workplace and it should have evaluated the site for hazards before exposing its employees.
