CAL. CODE REGS, tit. 8, 3329(d) (2001) - An employee failed to follow required procedures to prevent spraying of hot water or steam before opening a pressurized system for repairs.
DEFENSE - INDEPENDENT EMPLOYEE ACTION
Although the defense was available to Employer because its mechanic was not shown to be a supervisor, it did not establish all of the required elements to support the defense.
