REPORTING - SERIOUS INJURY

CAL. CODE REGS, tit. 8, 342(a) (2001) - The Appeals Board reversed an ALJ decision granting Employer's appeal from a violation for failure to report a serious injury to the Division. Employer, as the primary employer, was responsible for reporting an injury, despite the fact that the employee had been leased to and the work site controlled by a secondary employer. The duty to report is non-delegable.
