CAL. CODE REGS, tit. 8, § 4853(d) (2001) - The Appeals Board agreed with the ALJ that Employer should be relieved of a citation for inadequate ventilation during welding of stainless steel. The cited section applies to inert-gas metal-arc welding, but not to gas tungsten-arc welding. The Division's argument that the "original intent" of the standard to include TIG welding should be the current interpretation was rejected.
