APPEAL - LATE FILING
The Appeals Board rejected Employer's petition to reconsider an Order closing its appeal file. While Employer filed the appeal by telephone on time, it did not follow up with paperwork for 4-1/2 months. In addition, Employer's contention that an Air Quality Board resolution of violations also resolved citations issued by the Division was rejected. The Cal/OSH Appeals Board is the proper forum to contest job safety and health citations.
