PIPELINES - FAILURE TO DE-PRESSURIZE BEFORE CUTTING
AL. CODE REGS, tit. 8, § 3329(d) (2002) - Employer failed to check that an elevator's hydraulic line had been emptied before workers cut into it with a torch, which resulted in a fire and burn injuries. The violation was accident-related serious.
PENALTY - RECALCULATED AND INCREASED
LAB. § 6319(d) (2002) - The Division inappropriately applied a penalty reduction for low likelihood when any reduction other than for employer size was not permitted.
