GUARDRAILS - ELEVATED WORK LOCATIONS
CAL. CODE REGS, tit. 8, § 3210(a) (2002) - Employer's laborer worked from the top of a wall 10 feet high that surrounded a pit room beneath a conveyor that carried refuse. The lack of guardrails was a serious violation, but it was not accident related because the violation was not the cause of his fall which resulted in serious injuries. Without the accident-related characterization, the $18,000 proposed penalty was not reasonable.
