CAL. CODE REGS, tit. 8, §§ 1632(b) and 3212(e) (2003) - The Appeals Board reversed an ALJ decision, finding that the Construction Safety Order requiring employee protection from skylight openings during construction did not apply in an accident situation where an employee fell through an existing, permanent skylight while on a roof for other purposes. The Division was not granted leave to amend the citation to the applicable General Industry Safety Order, so the citation could not stand.
