FIELD SANITATION - OPERATIONAL TOILETS
Cal. Code Regs, tit. 8, § 3457(c)(3)(B) (2003) - The Appeals Board agreed with the ALJ that members of Employer's field crew were exposed to toilets mounted on an unstable trailer which were therefore not in operable condition. The evidence proved that the toilets were supplied by Employer for its workers.

The Appeals Board held that the ALJ did not commit a prejudicial procedural error when it admitted into evidence Division photographs which had not been supplied to Employer after it made a
