CAL. CODE REGS, tit. 8, § 1670(a) (2003) - The Division did not have reliable evidence other than hearsay that employees worked at a height requiring fall protection. Employer's evidence showed that the work was covered by and permitted by a different safety order.

EVID. §§ 225 and 1200(a) (2003) - The Division's hearsay evidence of a violation was less strong than Employer's foreman's authorized admission as to the location of an employee before a fatal accident occurred.
