LADDERS - SECURING
Cal. Code Regs, tit. 8, § 1675(j) (2004) - Employer failed to ensure that its employee, a foreman, kept a portable extension ladder secured against displacement. He fell and was seriously injured. The serious classification and accident-related characterization of the penalty were found appropriate, as was the proposed penalty.

PENALTY - FINANCIAL HARDSHIP
Despite the fact that it was no longer in business, Employer submitted insufficient proof of financial hardship to warrant penalty reduction or elimination.
