DIVISION OF OCCUPATIONAL SAFETY AND HEALTH - FAILURE TO COMPLY WITH APPEALS BOARD ORDER
Cal. Code Regs, tit. 8, §§ 347(e) and 381(a) (2004) - The Division failed to timely comply with a Board Order on Motion related to an inspector's ability to appear at a scheduled appeal hearing. It was also unable to satisfy an Order to Show Cause subsequently issued by the Board, and the witness was excluded from testifying at a later hearing. All citations and penalties were dismissed when no evidence was presented.
