Code Regs, tit. 8, §§ 4237(a) and (b) (2004) - While violations for failure to guard the ends and shaft of a buffing machine were not challenged and were established by operation of law, the Division did not prove the substantial probability that serious injury would occur from an accident. The serious classifications were reduced to general and the penalties recalculated accordingly.
