EQUIPMENT - MAINTAINING IN SAFE OPERATING CONDITION
Cal. Code Regs, tit. 8, § 3328(g) (2005) - Employer's welders used a chain with a defective swivel hook, which caused a serious injury accident. But the hook was assembled defectively before the employees found and used it, probably by the manufacturer, and the citation charged a failure to properly maintain equipment, not the use of defective equipment. The citation was dismissed.
