FALL PROTECTION - GENERAL V. ROOF OPERATIONS
Cal. Code Regs, tit. 8, § 1670(a), § 1730(a) (2005) - Employer's argument that roofing safety orders applied, rather than general construction regulations, was rejected. A roofing company employee not wearing fall protection had been sweeping tree debris at the edge of a roof before falling 15 feet, but he was not engaged in any roofing activity at the time. He should have been wearing fall protection, required for work above 7-1/2 feet, and was not subject to the 20-foot allowance permitted in roofing safety orders.
