SAFE PRACTICES AND PERSONAL PROTECTION, PERSONAL SAFETY DEVICES AND SAFEGUARDS – HEAT ILLNESS PREVENTION, PROVISION OF DRINKING WATER Cal. Code Regs, tit. 8, § 3395(c) (2019) – Employer’s non-air-conditioned buses were “outdoor” places of employment. Employer failed to provide drinking water, as required. SAFE PRACTICES AND PERSONAL PROTECTION, PERSONAL SAFETY DEVICES AND SAFEGUARDS – HEAT ILLNESS PREVENTION, ACCESS TO SHADE Cal. Code Regs, tit. 8, § 3395(d) (2019) – Employer’s non-air-conditioned buses were “outdoor” places of employment. Employer failed to demonstrate it established alternative measures to provide cooling, that were as effective as shade, for its drivers. SAFE PRACTICES AND PERSONAL PROTECTION, PERSONAL SAFETY DEVICES AND SAFEGUARDS – HEAT ILLNESS PREVENTION PLAN AND TRAINING Cal. Code Regs, tit. 8, § 3395(e) (2019) – Employer’s non-air-conditioned buses were “outdoor” places of employment. Employer failed to show that it had a heat illness plan in effect pertaining to the drivers of its non-air-conditioned buses.
