PENALTIES – FAILURE TO REPORT SERIOUS INJURY
Cal. Code Regs, tit. 8, § 342(a), Labor Code § 6317 (2013) – The Division conducted an investigation and cited Employer within six months of notification of a serious, work-related injury. Employer violated the cited safety order by failing to report a serious violation.

INJURY AND ILLNESS PREVENTION PROGRAM (IIPP) – TRAINING ON NEW JOB ASSIGNMENT
Cal. Code Regs, tit. 8, § 3203(a)(7)(C) (2013) – Employer failed to provide training and instruction to an employee who was given a new job assignment on a sliding compound miter saw. The Division established a serious violation.

MITER SAWS – GUARDING
Cal. Code Regs, tit. 8, § 4307.1(a)(1) (2013) – Employer violated the safety order by its failure to guard a miter saw. The independent employee action defense was inapplicable, as it does not apply where a machine is not properly guarded.
