JURISDICTION – RES JUDICATA AND COLLATERAL ESTOPPEL
The principle of res judicata barred Employer’s argument that its motion to dismiss, on the grounds that the Division lacked jurisdiction to cite it, was improperly denied. Employer had raised the identical issue previously before the Board; the Division was the opposing party; and the Board had rendered a final decision.

JURISDICTION – CORRECTIONAL INDUSTRIES
Labor Code §§ 6307, 6304.2 (2013) – The Division had jurisdiction to cite Employer, a public agency that employs prisoners in industrial enterprises, without first conducting hearings or other procedures.
