INJURY AND ILLNESS PREVENTION PROGRAM - TRAINING AND INSTRUCTION ON NEW MACHINES
Cal. Code Regs, tit. 8, § 3203(a)(7)(D) (2011) - The evidence supported that Employer failed to train an employee with respect to the use of a guard on a boring machine, after that machine was introduced to the workplace. However, the ALJ reduced the proposed penalty. 

INJURY AND ILLNESS PREVENTION PROGRAM - SUPERVISORS
Cal. Code Regs, tit. 8, § 3203(a)(7)(F) (2011) - The evidence did not support that Employer failed to provide adequate training to its supervisors to familiarize them with the hazards to which employees under their supervision might be exposed. 

INJURY AND ILLNESS PREVENTION PROGRAM - SCHEDULED PERIODIC INSPECTIONS
Cal. Code Regs, tit. 8, § 3203(a)(4) (2011) - The evidence did not support that Employer conducted inadequate inspections of several boring machines. 

MOVING PARTS OF MACHINERY AND EQUIPMENT - GUARDING
Cal. Code Regs, tit. 8, § 4002(a) (2011) - Employer failed to ensure the presence of a guard to prevent a pneumatic ram on a boring machine from coming into contact with the machine operator’s hands. The serious classification and $18,000 penalty were appropriate.
