CARCINOGEN REPORT OF USE REQUIREMENTS - EMERGENCY
Cal. Code Regs, tit. 8, § 5203(f) (2009) - The Division failed to prove that an “emergency” existed. Therefore, there was insufficient evidence that Employer violated the safety order.

ASBESTOS - REGULATED AREAS
Cal. Code Regs, tit. 8, § 1529(e) (2009) - Employer’s Class I asbestos removal work was not done in the presence or supervision of a “competent person.”

ASBESTOS - EXPOSURE ASSESSMENTS AND MONITORING
Cal. Code Regs, tit. 8, § 1529(f)(1)(A) (2009) - Employer removed the asbestos-containing thermal system insulation without performing the required exposure monitoring.

ASBESTOS - RESPIRATORY PROTECTION
Cal. Code Regs, tit. 8, § 1529(h)(1)(A) (2009) - The citation lacked the specificity required by due process considerations to provide Employer with adequate notice of the allegations against it. In addition, the evidence was inadequate to establish a violation. 

ASBESTOS - LABELING OF STORED DEBRIS
Cal. Code Regs, tit. 8, § 1529(k)(8)(A) (2009) - Employer stored asbestos-containing debris in unlabeled plastic bags, in violation of the safety order.

ASBESTOS - TRAINING
Cal. Code Regs, tit. 8, § 1529(k)(9)(A) (2009) - Employer failed to provide suitable training for employees who removed asbestos-containing material.

STANDARD RAILINGS - RAILINGS AND TOEBOARDS
Cal. Code Regs, tit. 8, § 1621(b) and (h) (2009) - The Division failed to prove that any employees were exposed to the hazards represented by either an unguarded elevator shaft opening or a floor lacking a toeboard at its edge. 

ASBESTOS - ENGINEERING CONTROLS AND WORK PRACTICES
Cal. Code Regs, tit. 8, § 1529(g)(1) (2009) - Employer failed to use a series of required engineering controls and work practices during the removal of asbestos-containing pipe and insulation.
