INJURY AND ILLNESS PREVENTION PROGRAM (IIPP) – EVALUATING UNSAFE WORK PRACTICES
Cal. Code Regs, tit. 8, § 3203(a) (2016) – Employer failed to evaluate unsafe work practices, as required by §3203(a)(4)(C). Additionally, Employer created a rule that required employees to use a safety chain or straps when driving a trash truck from the right side. Employer had methods or procedures for correcting an unsafe or unhealthy condition, but the method, using the safety chain, was not timely implemented. The Division also established a violation of §3203(a)(6).

TRANSPORTATION OF EMPLOYEES AND MATERIALS – TRANSPORTING EMPLOYEES, CHAINS OR CABLES USED IN LIEU OF DOORS ON REGULAR MEANS OF ENTRANCE OR EXIT
Cal. Code Regs, tit. 8, § 3702(q) (2016) – Employer failed to comply with the safety order because employees were allowed to not use a safety chain, in lieu of a door, on trash trucks during stop-to-stop operations.

VIOLATION – WILLFUL CLASSIFICATION
Cal. Code Regs, tit. 8, § 334(e) (2016) – Employer willingly and knowingly failed to address the safety hazard of not using the safety chain on a trash truck without a right side door.
