POWERED INDUSTRIAL TRUCK OPERATOR TRAINING – REFRESHER TRAINING AND EVALUATION CONDUCTED AT LEAST ONCE EVERY THREE YEARS
Cal. Code Regs, tit. 8, § 3668(d)(2) (2013) – Employer failed to evaluate the forklift performance of an employee, a general violation.

FLOOR, ROOF, AND WALL OPENINGS TO BE GUARDED – WALL OPENINGS
Cal. Code Regs, tit. 8, § 1632(j)(1) (2013) – Employer failed to guard a wall opening as required, a serious violation. An employee was exposed to the hazard, and there was no evidence that Employer’s failure to guard the wall opening was a safer course of action, or was part of a sequence of actions leading to compliance with the requirement.

INDUSTRIAL TRUCKS – FORKS, FORK EXTENSIONS AND OTHER ATTACHMENTS SECURED
Cal. Code Regs, tit. 8, § 3650(s) (2013) – Employer failed to ensure that a debris box attachment was properly secured to a forklift. The ALJ reclassified the violation from serious to general.
