EXCAVATIONS - INSPECTION BY COMPETENT PERSON
Cal. Code Regs, tit. 8, § 1541(k)(1) (2013) - Employer’s foreman was a “competent person” who evaluated the soil on the walls of a trench and inspected the excavation for any potential cave-in hazard on the day of the inspection. The Division failed to establish a violation of the safety order.
