FINANCIAL HARDSHIP – ADDITIONAL PENALTY RELIEF
Labor Code § 6602 (2019) – Although Employer did not demonstrate how additional penalty reduction would further the purposes of the Cal/OSH Act, the total proposed penalty created an extraordinary level of hardship and made it more punitive than equitable, the Appeals Board found. As a result, the Board exercised its authority to grant additional penalty relief.
