FINANCIAL HARDSHIP - EMPLOYER NOT OUT OF BUSINESS The record showed that Employer’s business was not closed and could have continued operating under a different name. Further, Employer’s financial condition did not justify additional reductions of the penalties. Granting penalty relief also would have been inconsistent with the Cal/OSHA Act due to Employer’s apparent indifference to worker safety.
