ELEVATORS – MANLIFTS Cal. Code Regs, tit. 8, § 3099(j) (2014) – The Board upheld the ALJ’s decision granting Employer’s appeal, but on different grounds. Although loading feed bags onto a manlift for transport, against Employer’s safety rules, was not an extreme departure from the injured employee’s assigned task of sweeping, bagging and moving junk feed, Employer established the independent employee action defense.
