Cal. Code Regs, tit. 8, § 1597(h) (2013) – An employee who was not wearing a seat belt rolled a water truck and suffered serious injuries. Employer failed to establish the independent employee action defense.
TRAFFIC CONTROL FOR PUBLIC STREETS AND HIGHWAYS
Cal. Code Regs, tit. 8, § 1598(a) (2013) – The Division did not establish that Employer failed to provide traffic controls in violation of the safety order. The worksite where the rollover occurred did not encroach upon public streets or highways.
