45 COR 40-8057 [¶22,873] LOW-VOLTAGE ELECTRICAL SAFETY ORDERS – ACCIDENT PREVENTION TAGS Cal. Code Regs, tit. 8, § 2320.6(a) (2018) – The Division failed to establish that Employer violated the safety order. Employer was not required to use an accident prevention tag on the elevator control panel when employees were not working on the de-energized equipment. CONSTRUCTION SAFETY ORDERS – INJURY AND ILLNESS PREVENTION PROGRAM (IIPP) Cal. Code Regs, tit. 8, § 1509(a) (2018) – The Division failed to establish that Employer violated the safety order. Employer provided an apprentice with training and instruction on the task he was performing. CONSTRUCTION SAFETY ORDERS – INJURY AND ILLNESS PREVENTION PROGRAM (IIPP), CODE OF SAFE PRACTICES (CSP) Cal. Code Regs, tit. 8, § 1509(b) (2018) – The Division failed to establish that Employer violated the safety order. Employer had a code of safe practices related to its operations that addressed the task being performed. SAFE PRACTICES AND PERSONAL PROTECTION, MISCELLANEOUS SAFE PRACTICES – CONTROL OF HAZARDOUS ENERGY FOR CLEANING, REPAIRING, SERVICING, SETTING-UP, AND ADJUSTING OPERATIONS OF PRIME MOVERS, MACHINERY AND EQUIPMENT, INCLUDING LOCKOUT/TAGOUT Cal. Code Regs, tit. 8, § 3314(g) (2018) – Employer did not have a hazardous energy control procedure to address unexpected release of stored energy when balancing the counterweight frame with the platform at various stages of construction. The Division established that Employer violated the safety order. SAFE PRACTICES AND PERSONAL PROTECTION, MISCELLANEOUS SAFE PRACTICES – MACHINERY AND EQUIPMENT Cal.
