CONSTITUTIONAL ARGUMENTS – DUE PROCESS
The Board rejected Employer’s argument that its due process rights were violated. The information in the citation was sufficient to put Employer on notice of the nature and substance of the charge, and allow it to formulate a defense.

INJURY AND ILLNESS PREVENTION PROGRAM (IIPP) – TRAINING DOCUMENTATION
Cal. Code Regs, tit. 8, § 3203(b)(2) (2014) – Employer complied with its responsibility to maintain employee training documents and provide them to the Division. The Board granted Employer’s appeal and vacated the civil penalty.
