PENALTIES – FAILURE TO REPORT SERIOUS INJURY
Cal. Code Regs, tit. 8, § 342(a) (2015) – Employer’s supervisor and other personnel could have timely reported to the Division a serious injury and a serious illness following a fire. As a result, Employer failed to support its exigent circumstances defense.

INJURY AND ILLNESS REPORTING PROGRAM (IIPP) – PROCEDURE TO INVESTIGATE OCCUPATIONAL INJURY OR OCCUPATIONAL ILLNESS
Cal. Code Regs, tit. 8, § 3203(a)(5) (2015) – Employer failed to implement its IIPP because it did not document the cause of the injuries to its employees or any corrective actions.

HAZARDOUS SUBSTANCES AND PROCESSES – STORAGE OF HAZARDOUS SUBSTANCES, EVALUATED FOR COMPATIBILITY BEFORE STORING
Cal. Code Regs, tit. 8, § 5164(a) (2015) – Employer violated the safety order because the substances that it utilized and that it instructed an employee to store in a waste storage area, were routinely mixed, after which they had a propensity for reacting violently or becoming hazardous by reasons of oxidizing power, flammability and explosibility. Employer also failed to evaluate the compatibility of the waste chemicals before its supervisor ordered the employee to store them.
