CONSTRUCTION SAFETY ORDERS – FLOOR, ROOF AND WALL OPENINGS TO BE GUARDED, TEMPORARY RAILINGS AND TOEBOARDS, OR COVERS
Cal. Code Regs, tit. 8, § 1632(b)(1) (2017) – The cited safety order did not apply to the circumstances surrounding the injury accident because the Division failed to show that a worker fell through an “opening” that existed prior to the accident, that the conditions were temporary, or that the alleged opening was the subject of work, construction or repair. Thus, the Division did not establish that Employer failed to ensure that floor openings in an attic were guarded by either temporary railings and toe boards, or by covers.
