Code Regs, tit. 8, § 1632(b)(1) (2017) – The cited safety order did not apply to the circumstances surrounding the injury accident because the Division failed to show that a worker fell through an “opening” that existed prior to the accident, that the conditions were temporary, or that the alleged opening was the subject of work, construction or repair.
