PENALTIES – FAILURE TO REPORT SERIOUS INJURY
Cal. Code Regs, tit. 8, § 342(a) (2015) – Employer failed to satisfy its independent duty to report a serious injury to the Division.
DEMOLISHING BUILDINGS – HAZARDS RESULTING FROM WEAKENED OR DETERIORATED FLOORS OR WALLS, OR LOOSENED MATERIAL
Cal. Code Regs, tit. 8, § 1735(d)(4) (2015) – Employer violated the safety order by failing to detect an inadequately braced wooden beam during demolition operations, and failing to prohibit employees from working where the hazard existed.
FINANCIAL HARDSHIP – NO PENALTY REDUCTION
The Board rejected Employer’s request for financial hardship penalty relief, noting that going out of business is not a rationale for penalty reduction.
