Cal. Code Regs, tit. 8, § 2500.8(a)(1) (2009) The ALJ properly determined that Employer’s employees were exposed to the hazard of flexible cords that were used as a substitute for fixed wiring.
NOTICE IN LIEU OF CITATION
Although the ALJ suggested in the decision that the Division should have issued a notice in lieu of citation, that was not a finding that the Division abused its discretion. Thus, the Board was not entitled to convert the citation to a notice in lieu.
