Code Regs, tit. 8, § 3210(b) (2011) - The ALJ erred in failing to recognize that the injured worker’s employment at a temporary yard was construction activity subject to the Construction Safety Orders. The Board concluded that a different safety order applied to the work activity, but the Division failed to establish a violation of that safety order.
