INJURY AND ILLNESS PREVENTION PROGRAM (IIPP) - Title 8, California Code of Regulations, §3203(a)(7) The Appeals Board found that Employer failed to train an employee on operating machinery adequately.  OPERATION OF MACHINERY AND EQUIPMENT – Title 8, California Code of Regulations, §3328(a)(2) The Appeals Board found that Employer failed to ensure the operation of machinery in accordance with the manufacturer’s recommendations. SERIOUS VIOLATION - REBUTTABLE PRESUMPTION - Title 8, California Code of Regulations, §6432(c) The Appeals Board determined the Serious classification was proper as there was a realistic possibility of serious physical harm.  Employer did not rebut the presumption.
