Code Regs, tit. 8, § 3999(a) (2017) – Employer failed to ensure that a screw conveyor below ground level was guarded by a substantial cover or grating. Moreover, it failed to demonstrate that it did not know or should not have known of the potential danger. The knowledge of its supervisory employees as to the hazard was imputed to Employer.
