45 COR 40-7969 [¶22,800R] CONSTRUCTION SAFETY ORDERS – ACCESS AND EGRESS, ELEVATORS FOR HOISTING WORKERS Cal. Code Regs, tit. 8, § 1630(a) (2018) – The Board affirmed a cited violation of §1630(a) for Employer’s failure to provide a construction passenger elevator once construction at the worksite reached 48 feet below ground level. VIOLATION – WILLFUL CLASSIFICATION Cal. Code Regs, tit. 8, § 334(e) (2018) – The Appeals Board concluded that Employer’s failure to provide a construction passenger elevator once construction at the worksite reached 48 feet below ground level was not a willful violation. Employer repeatedly attempted to identify, address and resolve the Division’s concerns, including making several offers to provide alternate means of access where unusual site conditions or structure configurations existed.
