Dir’s Proposed Rules for Prop. 65 Enforcement Include 60-Day Notices

OAKLAND -- Private parties who bring enforcement actions under the occupational provisions of Proposition 65 will have to serve both the alleged violator and the state Attorney General (AG) with a 60-day notice of the action, under regulations proposed by the Department of Industrial Relations (DIR).The regulations have been under development since 1997, when Fed-OSHA approved the incorporation of the occupational applications of Prop. 65 into California's Hazard Communication (hazcom) standard.
