PERMIT TO EXCAVATE. The Appeal was granted and the citation dismissed along with the proposed civil penalty of $40 for the alleged violation of a safety order requiring that an employer obtain a permit from the Division of Industrial Safety prior to construction of a trench or excavation (Sec. 1539).
