Trenches, General. The Appeal was denied in part and granted in part, affirming the violation of a safety order requiring effective guarding against the hazard of moving earth in trenches 5 feet or more in depth (1541(a)) but vacating the Respondent's finding that the violation was serious and wilfull.
In vacating the characterization of the violation as "serious," the Board concluded that the Division had improperly classified it as "serious" on the basis that the evidence indicated that the soil was very stable
