Exposure to the Hazard, Failure to Establish. The Appellant/Petitioner argued that the evidence submitted in the original case did not establish that employees of the Appellant were exposed to the hazards. (See Digest 11,182.) The Appeals Board, in reviewing that decision, found that the Division failed to show employee exposure sufficient to establish a violation.
