The Appeals Board affirmed the ALJ decision of February 1, 1979 (Digest 13,090). In doing so, it rejected Employer's defense to a charge of serious violation of 3999(b) (conveyors). It also affirmed (without comment) the ALJ's authority to reduce the amount of the proposed penalty. (The Division, in a separate petition for reconsideration, contended the ALJ acted in excess of his powers in reducing the penalty to $185.)
